Modern construction contracts are typically developed using one of three groups of standard construction agreements: AIA construction contracts, EJCDC forms, and AGC/ConsensusDOCS construction project agreements.

These standard contract forms are intended to facilitate contract negotiations and provide a certain level of uniformity in the area of construction contracts. It is, however, essential that you obtain good advice regarding which category of standard contract to use and which among the array of forms is appropriate for a given project. AIA Construction Agreements

The AIA documents program is the oldest in the country. Begun in 1857, the AIA program offers 40 new and revised contract forms. The AIA is perhaps best known for offering a combination of documents based on the A201 keystone form, the General Conditions of the Contract for Construction.

Also available through AIA is the A101 – Standard Form of Agreement Between Owner and Contractor. This form is related to the Stipulated Sum and B101 – Standard Form of Agreement Between Owner and Architect, which addresses the basis of payment. The AIA renews its documents every 10 years. Its documents were last updated in November of 2007.

EJCDC Contracts

The Engineers Joint Contract Documents Committee’s (EJCDC) primary goal is in providing high quality administrative documents for construction projects that require professional engineering services. The EJCDC’s most recent construction documents, released in March of 2007, are often used in horizontal and utilities construction projects.

ConsensusDOCS Construction Contracts and Forms

ConsensusDOCS represents the efforts of 20 construction associations that have produced more than 70 standard construction forms that were first released in September of 2007.

ConsensusDOCS are grouped into several different categories: general contracting, design-build, construction management, subcontracting and program management. ConsensusDOCS also provides an innovative three-way agreement form between and owner, designer and constructor, the ConsensusDOCS 300 — Standard Form of Tri-Party Agreement for Collaborative Project Delivery.
