We regularly assist our contractor clients in the avoidance, prosecution and defense of innumerable claims ranging from the collection of contract payments to extremely complex and sophisticated construction matters such as those associated with delay, disruption and acceleration of construction projects.
We have extensive experience in the negotiation, mediation, arbitration and litigation of these claims both privately and in state and federal courts.
Accounts Receivable and Payment Disputes
We also regularly counsel our contractor and surety clients on issues regarding contract default, termination, payment and recovery. Due to our sophistication and experience in this area, we are able to assist our clients in these matters in a timely and cost effective manner. Securing contract payments through bonds, liens and insurance is also part of our every day practice.
Loss Prevention and Contracts — Avoiding Liability
For our design professional clients we provide counsel on both contract negotiation and dispute resolution. We advise our clients on the implementation of loss prevention measures to protect against losses associated with the use of increasingly more complex project delivery systems. If problems and issues arise, we prosecute and/or defend errors and omissions claims.
Labor Contracts and Employment Issues
We are frequently called upon to address labor and employment issues common to the construction industry such as prevailing wage, worker benefit and jurisdictional issues. We often assist in the negotiation and development of, or resolution of disputes under, project labor agreements.
